Citizens from the specified countries represent approximately 40% to 45% of immigrant visa recipients. As a result, the suspension potentially would have halted close to half of all lawful immigration within a year. While employment-based petitioners participated as plaintiffs, the bulk of the contested cases involved family immigration.

Judge Jeannette Vargas stated that Congress granted consular officers authority to assess each applicant’s eligibility. The ruling eliminates nationality as an automatic basis for refusal.
