Biohaven Shares Surge 25% Following Court’s $4 Million MODA Ruling

Shares of Biohaven jumped on Wednesday after a federal court finalized its win in a trade-secret lawsuit, boosting the clinical-stage drugmaker’s market capitalization by about $553 million.

The cash prize totaled just $4 million, with $1 million going to Biohaven. Investors seemed to value increased safeguards for a platform backing two pivotal-stage programs instead.

Biohaven Ltd. (NYSE:BHVN) was last at $18.04 as of 14:10 EDT, up $3.66, or 25.47%, from Tuesday’s close. Trading volume stood at 10.34 million shares, compared with the three-month average of 2.87 million market data.

Delaware federal court Judge Jennifer Hall issued a judgment on Monday after a jury determined that RA Capital and Avilar Therapeutics intentionally misappropriated Yale’s MODA trade secret. The court granted Yale $3 million in damages and Biohaven $1 million Biohaven release.

Biohaven obtains rights to use the MODA platform from Yale for drug creation and commercialization. CEO Vlad Coric said the verdict affirmed that confidential data helped launch a rival business July verdict statement.

The disparity between damages and valuation reflects the market’s true priorities. The decision backs Biohaven’s assertion of a unique extracellular protein-degradation platform rather than immediate profits.

The platform serves as the foundation for Biohaven’s primary immunology pipeline. BHV-1300 began a pivotal Phase 3 Graves’ disease study in June. A pivotal BHV-1400 study in IgA nephropathy is scheduled for the second half of 2026 quarterly update.

Initial patient data showed BHV-1300 cut pathogenic antibodies by over 80% at 12 weeks. BHV-1400 achieved about a 70% reduction within the first month. These findings do not indicate clinical benefit or imply regulatory approval.

Biohaven has yet to generate revenue. For the second quarter, it posted a loss of $137.3 million, including $100.8 million spent on research and development. During the first half, operating cash outflows stood at $235.0 million SEC filing.

Management anticipates that existing liquidity will suffice to meet commitments for at least the next year. The company also notes that further funding will be necessary prior to generating significant product revenue. As a result, equity financing continues to pose a risk of dilution.

Yahoo analysts currently assign Biohaven a 1.8 rating, labelled as “Buy.” On Wednesday, the company’s market capitalization stood at $2.73 billion, with prospects tied mainly to clinical trial outcomes rather than the legal judgment.

Risks: RA Capital has rejected any misconduct and indicated it will pursue post-trial motions, an appeal, and patent counterclaims. The court further emphasized the judgment is still subject to post-trial review New Haven Register.

Investors are set to assess the next valuation milestones at the clinic, focusing on the pivotal launch of BHV-1400, enrollment progress for BHV-1300, and data on obesity and epilepsy expected in the second half.
