BRUSSELS, September 5, 2026, 8:50 a.m. CEST — BNB (BNB-USD) traded near $726.58 Saturday, up 0.8% in 24 hours. The muted move contrasts with a fresh question over how Binance serves some European customers without a MiCA license.
- BNB gained 4.7% from August 30 and carried a $96.8 billion market value.
- Binance does not appear in ESMA’s August 21 list of authorized providers.
- The exchange still handled more than 45% of global spot volume in late August.
- ESMA describes the reverse-solicitation exemption as narrow and fact-specific.
The price reaction suggests traders see the immediate financial risk as contained. That view rests partly on Binance’s global reach. Its euro-denominated share was only 3% to 4% in late August.
There is an important limit to that signal. BNB is a utility token, not Binance equity. Holders have no direct claim on the exchange’s revenue or cash.

MiCA’s transition period ended July 1. Existing firms then needed authorization or an approved exit path. Authorization in one member state can open covered services across the European Economic Area.
ESMA’s interim register was last updated August 21. It contains 331 unique authorized legal entities. A TS2 review found no Binance legal or commercial name.
Binance also does not appear among 162 unique names in ESMA’s non-compliant-entity file. The absence establishes neither approval nor a formal breach. It leaves the licensing status unresolved.

Bloomberg reported that Binance relies partly on reverse solicitation. Under that exception, a European customer approaches a foreign provider on the customer’s own exclusive initiative.
Some European trading was routed through a Binance entity in Abu Dhabi, the report said. Customers in several countries had earlier been limited to withdrawals. Some later regained access.
ESMA says genuine reverse solicitation is “very limited and very narrowly framed.” Marketing, promotion and advertising can disqualify the exemption. Supervisors assess all facts and circumstances.
Binance told Bloomberg it was “actively working toward becoming MiCA-authorised.” The exchange said it wanted a consistent and regulated European service. It has not named its next application venue.
Global scale still outweighs the euro footprint

The scale gap explains the calm token market. Binance can absorb a smaller euro franchise while it seeks approval. Yet authorization gives rivals a cleaner path to acquire European customers.
Coinbase Global, Inc. NASDAQ:COIN appears in the register through its Luxembourg entity. Kraken and Bitstamp also hold authorizations. Each lists services across 30 EEA countries.
Risks: A regulator could challenge Binance’s interpretation and restrict onboarding or trading. A successful license could remove that overhang. BNB may still move on crypto demand unrelated to Europe.
The next evidence will come from two places. ESMA updates its register weekly, while Binance has yet to disclose another application. Investors should also watch whether euro market share breaks from its 3% to 4% range.
